Malpractice in Costa Rica: Medical, Legal and Other Claims

Malpractice in Costa Rica: Medical, Dental, Legal and Construction Claims

Malpractice in Costa Rica covers any case where a doctor, dentist, lawyer, notary, engineer, architect or other professional falls short of the standard their field requires and causes harm. With thousands of people coming every year for dental work, cosmetic surgery and other procedures, and many foreigners buying property and building homes here, these cases come up more often than people expect.

They are also highly technical. A bad result alone is not enough: you have to show the professional departed from what a careful colleague would have done in the same situation. This guide explains how that standard works, what legal paths exist and why expert evidence usually decides the outcome. It is part of our guide to civil liability in Costa Rica.

Quick Take

  • A professional is liable when they act with negligence, carelessness or lack of skill under the standards of their field, known as lex artis.
  • Most professionals promise best efforts, not results: they do not guarantee an outcome, but they must use proper knowledge and care.
  • Claims against Costa Rican clinics and professionals are generally brought in Costa Rica, under Costa Rican law.
  • Three paths can run in parallel: civil, disciplinary and criminal.
  • Independent expert evidence is almost always the deciding factor.

What malpractice means in Costa Rica

When you hire a professional, you rely on knowledge you do not have. That is why the law requires a level of care that matches their training. If they fall short and cause harm, they must pay for it. The legal basis can be contractual, under Article 702 of the Civil Code, when there is a services agreement, or non-contractual, under Article 1045, when the harm happens outside that relationship.

The central question is always the same: did the professional act as a prudent, competent colleague would have acted in the same circumstances? That standard is called lex artis, and its content comes from the protocols, science and accepted practice of each field. Costa Rican law does not use the term “malpractice” as a separate cause of action; these are professional liability claims under the general civil liability rules.

Medical and dental tourism: what to know

Costa Rica has a strong reputation for medical and dental care, and most procedures go well. When something does go wrong, foreign patients face a few specific realities:

  • The claim usually belongs in Costa Rica. A Costa Rican clinic or professional is generally sued here, under Costa Rican law, even if you live elsewhere.
  • Get your records before you leave. Request a complete copy of your clinical file, imaging, consent forms and invoices while you are still in the country, if possible.
  • Corrective treatment back home matters. Reports from the doctors who treat the complication can become key evidence, but foreign documents will need an apostille and an official Spanish translation.
  • Cosmetic procedures are judged closely. In elective and aesthetic procedures, what was promised and what risks were explained carry special weight.
  • Check credentials. The College of Physicians and Surgeons lets you verify whether a doctor is licensed and holds the specialty they claim.

Best efforts vs. guaranteed results

This distinction shapes what you must prove and often who wins:

TypeWhat the professional promisesExamplesWhat the claimant must prove
Best effortsTo use proper knowledge, diligence and care, without guaranteeing the outcome.Medical treatment, defending a lawsuit, legal advice. That the professional departed from lex artis and that this caused the harm.
Specific resultTo achieve a concrete, verifiable result.Certain technical work, a property registration, some construction work. That the promised result was not achieved.

Which category a service falls into is not always obvious. Some elective cosmetic procedures, for example, are argued to be closer to a result-based obligation. Classifying the case correctly is part of the initial work.

Medical malpractice in Costa Rica

Medical claims can arise from a wrong or late diagnosis, a surgical error, the wrong medication, infections caused by protocol failures or a lack of follow-up care.

Informed consent

Before a procedure, patients have the right to clear information about its risks, alternatives and consequences. Law 8239 on the Rights and Duties of Users of Public and Private Health Services recognizes these rights. If a patient was not told about a risk that later materialized, there may be liability even if the procedure itself was technically correct.

The medical record

The clinical file is the core evidence in any medical case, and patients have the right to access their information. Getting a complete copy should be one of the first steps.

Private vs. public care

If care was provided at a private hospital or clinic, the claim is brought against the professional and the facility in civil court. If it was provided by the CCSS, the public health system, or another public institution, government liability under Article 190 of the General Public Administration Law applies, and the case goes to the administrative courts with their own rules and deadlines.

A complaint can also be filed with the Prosecutor’s Office of the College of Physicians and Surgeons, which investigates the doctor’s ethical and professional conduct. That route does not award compensation, but its outcome can be relevant.

Lawyers and notaries

For foreigners, this is often the most painful kind of case, because it usually involves a property purchase or an investment. A lawyer may be liable for letting a claim expire, missing a filing deadline, overlooking key evidence or giving advice that clearly contradicts the law. Because the obligation is usually one of best efforts, losing a case is not enough on its own; you have to show the specific error and that the outcome would probably have been different without it.

Notaries play a central role in Costa Rican real estate. A defective deed, a skipped title search or a registration that never happened can cause serious financial loss. Besides the civil claim, notaries are subject to the disciplinary regime of the Notarial Code, with the involvement of the National Notary Directorate. Lawyers answer for discipline to the Costa Rican Bar Association. If the problem has left you in a fight over who owns a property, see our guide to land disputes in Costa Rica.

Engineers, architects and builders

Design, calculation, supervision or construction defects can show up as cracks, leaks, structural failures or a building that does not match its approved plans. Beyond the contract claims against the builder, covered in breach of contract in Costa Rica, the Civil Code also provides for a special liability of the builder for serious defects for a set period after delivery.

Professionals who sign off as technically responsible for a project can also be reported to the Federated College of Engineers and Architects. In these cases an independent engineering report is essential to separate design defects from construction and maintenance problems.

Other professionals

Professional liability reaches any field that requires specialized knowledge: accountants and auditors who miss obvious irregularities or file returns with errors, financial advisers, surveyors, appraisers, software developers, and health professionals other than physicians, such as dentists, psychologists or physical therapists.

The same logic applies every time: identify the standard of the field, show it was not met and prove that the failure caused the harm. When the service was provided in a consumer relationship, consumer protection rules may also come into play depending on the case. The Ministry of Economy’s consumer protection portal is the official reference.

Three paths: civil, disciplinary and criminal

A single professional error can lead to three separate processes, each with a different purpose:

PathWhereWhat it achieves
Civil or administrativeCivil courts or, if the professional is public, the administrative courts.Compensation for your losses.
DisciplinaryThe relevant professional college or authority.Sanctions against the professional: warning, suspension or disbarment.
CriminalThe Public Prosecutor’s Office and criminal courts.Punishment for crimes such as negligent injury or homicide. Compensation can be claimed through a civil damages action in the criminal case.

Choosing which paths to pursue, and in what order, is a strategic decision. A poorly prepared complaint can produce statements or evidence that later complicate the civil claim.

Expert evidence decides these cases

In professional liability cases, the judge needs an expert to explain what should have been done and what was actually done. That is why the expert report is almost always the most important evidence. In medical cases, the Judicial Branch has its own Legal Medicine Department, and the parties can also submit reports from independent specialists. In technical cases, engineering, accounting or other experts in the relevant field are used.

Beyond the expert report, gather the complete file of the service, contracts, quotes, messages, invoices and anything that shows what was promised and what happened. For valuing your losses, see our guide to suing for damages in Costa Rica.

Deadlines in malpractice cases

Deadlines depend on the path and on who is responsible. Claiming against a private professional is not the same as claiming against a public institution, and the disciplinary and criminal routes have their own time limits. In medical cases, harm sometimes appears long after the procedure, which raises questions about when the clock starts. We explain the general rules in our guide to civil liability in Costa Rica, but the practical advice is to act early, especially if you are back home and the evidence is here.

If you are the professional facing a claim

Receiving a claim or complaint is a serious matter that affects any professional's reputation and peace of mind. First, do not respond impulsively, do not alter any records or files and notify your insurer right away if you have professional liability coverage. Several professional associations, including the Costa Rican Bar Association, offer this kind of policy to their members.

A solid defense examines whether the lex artis was followed, whether there was informed consent, whether the harm has another cause and whether the claim was filed in time. AG Legal also advises professionals and companies in this position.

Common mistakes in malpractice claims

  • Confusing a bad outcome with malpractice. With a best-efforts obligation, you need to prove the error, not just the result.
  • Leaving the country without your records or the full documentation of the service.
  • Going public first, on social media or review sites, and exposing yourself to a defamation claim.
  • Pursuing every path at once without a strategy, producing contradictory statements.
  • Skipping an independent expert and relying only on the professional's or the institution's version.
  • Letting time pass while waiting for an explanation that never comes.

Frequently Asked Questions

What counts as malpractice in Costa Rica?

Harm caused when a professional fails to meet the standard of care and knowledge their field requires. It is handled under Costa Rica's general civil liability rules.

What is lex artis?

The set of technical rules, protocols and accepted practices of a profession. It is used to measure whether the professional acted as a prudent, competent colleague would have.

Is every bad medical outcome malpractice?

No. Most medical care is a best-efforts obligation: the doctor does not guarantee the result but must act with proper care. You need to show a departure from lex artis that caused the harm.

I had surgery or dental work in Costa Rica and went home. Can I still make a claim?

Yes. Claims against Costa Rican clinics and professionals are generally brought in Costa Rica, and your lawyer can act under a special power of attorney. Reports from your doctors back home can be used once apostilled and officially translated.

Can I sue the CCSS for malpractice?

Yes. The General Public Administration Law makes the State liable for harm caused by its operations. These cases go to the administrative courts, with their own rules and deadlines.

What is informed consent?

The patient's right to clear information about the risks, alternatives and consequences of a procedure before agreeing to it. Without it, there may be liability even if the procedure was technically correct.

Can I get a copy of my medical records in Costa Rica?

Yes. Law 8239 recognizes patients' right to access their clinical information. Getting a complete copy is one of the first steps in any claim.

Can I sue my lawyer or notary in Costa Rica?

Yes, if you can show a specific error, such as a missed deadline or a defective deed, and that it caused your loss. Notaries are also subject to the Notarial Code's disciplinary regime.

Is the builder responsible for defects that appear after the work is delivered?

Yes. Besides contract liability, the Civil Code provides for a special liability of the builder for serious defects for a set period after delivery.

Does a complaint to a professional college get me compensation?

No. Disciplinary proceedings sanction the professional but do not award compensation. For that you need a civil or administrative claim, or a civil damages action in a criminal case.

What evidence do I need in a malpractice case?

Mainly an independent expert report, the complete records of the service and proof of the losses you suffered.

Were you harmed by a professional error, or is someone making a claim against you?

We review your case confidentially, coordinate experts and tell you which paths to pursue and in what order.
